Your Customer Rights with Holland Sail
When you book a multi-day sailing trip through Holland Sail, it is considered a package trip. As a customer, you have rights and protections that you can benefit from. These rights are included in the European Package Travel Directive. We are happy to inform you about these rights and protections on this page.
- Essential Information: Travelers will receive all essential information about the package trip before entering into the package travel contract.
- Liability: There is always at least one operator responsible for ensuring the proper provision of all services included in the contract.
- Emergency Contact: Travelers will receive an emergency phone number or contact details for getting in touch with the tour operator or travel agency.
- Transfer of the Package Trip: Travelers may transfer the package trip to another person within a reasonable period and possibly at additional costs.
- Price Increase: The price of the package trip may only be increased if certain costs (e.g., fuel prices) rise and this is explicitly provided in the contract. In any case, the price increase must occur at least 20 days before the start of the package trip. If the price increase exceeds 8% of the total package price, the traveler may cancel the contract. If the operator reserves the right to increase prices, the traveler is entitled to a price reduction if corresponding costs decrease.
- Right to Cancel for Substantial Changes: If any essential part of the package trip (except the price) is significantly changed, travelers can cancel the contract without paying a cancellation fee and receive a full refund of all payments. If the tour operator cancels the package trip before it begins, travelers are entitled to a refund and possibly compensation.
- Exceptional Circumstances: Travelers can cancel the contract without paying a cancellation fee before the start of the package trip if there are exceptional circumstances, e.g., serious safety concerns at the destination that are expected to affect the trip.
- Cancellation Fees: Travelers can cancel the contract at any time before the start of the package trip by paying a reasonable and proportionate cancellation fee.
- Major Changes During the Trip: If essential parts of the package trip cannot be provided as agreed after the trip has started, the traveler must be offered reasonable alternative arrangements without additional cost. The traveler may cancel the contract without a cancellation fee if services are not provided according to the contract and this significantly affects the performance of the package trip, and the tour operator fails to rectify the situation.
- Price Reduction or Compensation: Travelers are entitled to a price reduction and/or compensation if the services are not provided or not provided correctly.
- Assistance: The tour operator will assist the traveler if they are in difficulty.
- Insolvency Protection: Holland Sail and all its affiliated cooperative members are covered by insolvency protection. If services cannot be provided due to the financial insolvency of the tour operator, please contact VZR Garant: VZR Garant, Torenallee 20, 5617 BC Eindhoven, Netherlands, by email (info@vzr-garant.nl) or phone at +31 (0)85 13 07 630.
